SafeTalk Terms of Service

IMPORTANT SAFETY NOTICE
SafeTalk is not a replacement for professional medical, legal, or therapeutic services. If you or someone else is in immediate danger, call 911 or your local emergency services immediately. SafeTalk cannot guarantee the prevention of harmful situations and should not be relied upon for crisis intervention.
1. Acceptance of Terms
By accessing and using SafeTalk ("the Service," "the App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, you should not use SafeTalk.
2. Description of Service
SafeTalk is a mobile application designed to facilitate communication between co-parents through:
- AI-mediated messaging with content filtering
- Conflict resolution and mediation tools
- Communication assistance and suggestions
- Safety and crisis detection features
- Audio and video calling between co-parents and for virtual visitation with children

SafeTalk provides technological tools to assist communication but does not provide legal advice, medical advice, or therapeutic counseling. Users should consult with qualified professionals for legal, medical, or mental health matters.
3. User Responsibilities
3.1 Eligible Users
- You must be at least 18 years old to use SafeTalk
- SafeTalk is intended for parents and legal guardians only
- You must provide accurate information during registration
- You are responsible for maintaining the confidentiality of your account
3.2 Acceptable Use
You agree to use SafeTalk only for its intended purpose and will not:
- Use the service for any illegal or unauthorized purpose
- Send threatening, harassing, or abusive messages
- Attempt to circumvent content filtering or safety features
- Share explicit, violent, or inappropriate content
- Impersonate another person or provide false information
- Attempt to hack, disrupt, or damage the service
- Use the calling feature to harass, intimidate, or repeatedly contact someone who has disabled calls
3.3 Audio and Video Calling
SafeTalk offers audio and video calling features subject to the following terms:
Mutual Consent Required
- Both users must enable the calling feature before calls can be placed or received
- You can enable or disable calling at any time from your settings
- Audio and video calling consents are separate—you may enable one without the other
- If either party disables calling, no calls can be placed between you
Call Recording
- Call recording iavailable only when both parties have consented to recording
- You will see a clear indicator when a call is being recorded
- By enabling call recording, you represent that you understand applicable recording laws in your jurisdiction
- Important: Some states (including California, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Pennsylvania, and Washington) require consent from all parties to record a conversation. It is your responsibility to ensure compliance with applicable laws.
- SafeTalk is not responsible for your failure to comply with recording consent laws
Call Conduct
- All calls must comply with the acceptable use policies in Section 3.2
- Do not use calls to threaten, harass, or intimidate your co-parent
- Respect boundaries—if your co-rent disables calling, do not attempt to pressure them to re-enable it
- SafeTalk reserves the right to suspend calling privileges for users who violate these terms
Technical Requirements
- Calling requires a stable internet connection (WiFi or cellular data)
- Call quality depends on your network conditions—SafeTalk does not guarantee uninterrupted or high-quality calls
- You must grant camera and microphone permissions to use video and audio calling
4. Content and Communication
4.1 Message Content
- You retain ownership of the content you create and send
- You grant SafeTalk permission to process your messages for AI filtering and mediation
- Messages may be analyzed by AI systems to ensure safety and appropriateness
4.2 AI Processing
- SafeTalk uses artificial intelligence to filter and moderate content
- AI suggestions are automatically generated and may not always be accurate
- Users should exercise judgment when using AI-generated suggestions
- AI processing may involve third-party services (such as OpenAI)
5. Privacy and Data
Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using SafeTalk, you consent to our Privacy Policy.
6. Safety and Crisis Management
6.1 Crisis Detection
- SafeTalk may detect potential crisis situations in messages
- We may provide crisis resources and emergency contact information
- Detection systems are automated and may not catch all situations
- Users should not rely solely on SafeTalk for crisis intervention
6.2 Reporting and Blocking
- Users can report inappropriate content or behavior
- Users can block other users to prevent communication
- We reserve the right to investigate reports and take appropriate action
- Severe violations may result in account suspension or termination
7. App Development and Updates
SafeTalk is under active development and will continue to evolve:
- Continuous Improvement: We regularly update SafeTalk to improve functionality, fix issues, and enhance user experience based on feedback from our users
- Feature Changes: Features may be added, modified, improved, or removed at any time as we develop the app further
- User Feedback: We actively incorporate user feedback to improve the service. By using SafeTalk, you acknowledge that the app experience may change over time
- AI and Algorithm Updates: Our AI systems, content filtering, and mediation features are continuously improved and may produce different results over time
- No Obligation to Maintain Features: We are not obligated to maintain any specific feature, functionality, or behavior of the app indefinitely
- Automatic Updates: Updates may be delivered automatically through app stores. Continued use of SafeTalk after updates constitutes acceptance of the modified service

8. Service Availability
- We strive to maintain continuous service availability
- Service may be temporarily unavailable for maintenance or technical issues
- We do not guarantee uninterrupted access to the service
- We reserve the right to modify or discontinue features with notice
9. Limitations of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- SafeTalk is provided "as is" without warranties of any kind
- We do not guarantee the accuracy of AI-generated content
- We are not liable for damages resulting from use of the service
- Our liability is limited to the amount paid for the service (if any)
- We are not responsible for actions taken based on AI suggestions
9.1 Calling Feature Limitations
- We do not guarantee call quality, availability, or uninterrupted service
- Calls may be dropped, delayed, or experience quality issues due to network conditions
- We are not responsible for your compliance with call recording consent laws
- We are not responsible for content shared during calls or conduct during calls
- Call recordings are stored securely but we cannot guarantee against all potential security breaches
- The calling feature should not be used for emergency communications—call 911 for emergencies
10. Indemnification
You agree to indemnify and hold SafeTalk harmless from any claims, damages, losses, or expenses arising from:
- Your use of the service
- Your violation of these Terms
- Yo violation of any third-party rights
- Content you submit or transmit through the service
For users in the European Economic Area (EEA), the United Kingdom, or Switzerland: The indemnification obligations in this Section 10 do not apply to you. Your liability to SafeTalk is limited to direct damages caused by your willful misconduct or gross negligence, as permitted under applicable consumer protection law in your jurisdiction.
11. Account Termination
11.1 Termination by User
- You may terminate your account at any time
- Account deletion will remove your personal data in accordance with our Privacy Policy
- Some information may be retained for legal or safety purposes
11.2 Termination by SafeTalk
- We may suspend or terminate accounts for violations of these Terms
- We may terminate accounts for safety or legal reasons
- We will provide notice when reasonably possible
12. Intellectual Property
- SafeTalk and its features are protected by intellectual property laws
- You may not copy, modify, or distribute SafeTalk software
- Our trademarks and logos may not be used without permission
- You retain rights to content you create
13. Changes to Terms
We may update these Terms of Service from time to time. Material changes will be communicated through the app or email. Continued use of SafeTalk after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of California, United States. Any disputes will be resolved in the courts of California, United States. If you are a consumer in the European Union, you may also have rights under local consumer protection laws.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
