1. Acceptance of Terms

SafeTalk, Inc. ("SafeTalk," "we," "us," or "our"), based in Redwood City, California, provides mobile app-based message processing and AI-assisted mediation tools for co-parents, including services for Family Court Services (FCS) referrals. These Terms form a binding agreement between you and SafeTalk.

By using the Service, you confirm that you have read, understood, and agree to these Terms.

2. Eligibility & Capacity

The Service is intended only for separated or divorced co-parents, or any individual with equivalent legal responsibility (such as a guardian with custody).

You must be at least 18 years old and have the legal capacity to enter a binding contract. By using SafeTalk, you represent and warrant that you meet these requirements.

3. Description of Services

SafeTalk is a subscription-based mobile app communication support tool designed specifically for co-parent communication.

Current Features:

  • Direct Chat: Filtered messaging with AI-powered reply suggestions
  • Message Processing: AI technology re-frames hostile content into respectful, child-focused language
  • Mediation Mode: Automatic conflict detection that freezes chat until resolution
  • User Control: You choose, edit, or create all final messages
  • In-App Delivery: Secure message delivery through the mobile app

Court Services Integration:

  • FCS Referrals: Accept and process Family Court Services referrals
  • Court Reporting: Provide compliance reports to referring courts (with user consent)
  • Legal Records: Generate court-admissible communication records

Future Features:

  • Parenting Plan: Guided onboarding and AI-mediated agreements
  • Court-Ready Plans: Structured agreements suitable for legal proceedings

⚠️ Important Service Limitations

SafeTalk is NOT:

  • Legal advice or a substitute for an attorney
  • Medical or therapeutic services
  • Emergency communication (dial 911 for emergencies)
  • A licensed mediation service

🔒 User Control Guarantee

All communications are 100% user-initiated. SafeTalk suggests AI-generated responses but never sends anything without your explicit approval.

4. User Accounts & Registration

To use SafeTalk, you must provide accurate registration information including valid contact information, emergency contact details, and co-parent contact information (with their consent). You must download the app from an authorized app store (Apple App Store or Google Play Store).

You are responsible for maintaining the confidentiality of your account and for all activities under your account.

5. User Responsibilities & Conduct

You agree not to use the Service to:

  • Harass, threaten, defame, or abuse others
  • Send unlawful, fraudulent, or infringing content
  • Violate privacy rights or wiretapping laws
  • Attempt to disrupt or misuse SafeTalk systems
  • Share sensitive personal information (SSNs, financial data, health records)
  • Use the Service during emergency situations requiring immediate response

SafeTalk may suspend or terminate accounts that violate these rules.

6. App Store Compliance & Distribution

Authorized Distribution

SafeTalk is distributed exclusively through authorized app stores (Apple App Store and Google Play Store). You may only download the app from these official sources. Use of modified or unauthorized versions is prohibited.

App Store Terms

Your use of SafeTalk is also subject to the applicable app store's terms of service (Apple App Store Terms or Google Play Terms of Service). In case of conflict, the more restrictive terms apply.

In-App Purchases & Subscriptions

Subscriptions and payments are processed through your app store account. Subscription management, cancellations, and refunds are handled according to the app store's policies.

Consent & Processing

By using SafeTalk, you consent to processing and storing your communications for AI-assisted message improvement and delivery between co-parents. You represent that you have obtained all required consents under applicable law.

Family Court Services Integration

If referred by Family Court Services, you acknowledge that additional terms apply including court oversight, progress reporting, and extended data retention. You consent to judicial access of communication records as required by court order.

SafeTalk is a communication tool only - not professional services.

8. Child Safety & Abuse Reporting

🛡️ Mandatory Reporting

SafeTalk personnel are mandatory reporters. We are legally required to report suspected child abuse, neglect, or imminent harm to appropriate authorities.

Child Safety Compliance: SafeTalk complies with child protection laws. If we become aware of evidence of child abuse, neglect, or imminent harm, we may be legally required to report it to authorities.

Service Restrictions: The Service must not be used to facilitate harm to children or conceal abuse. Misuse may result in account suspension and referral to law enforcement.

9. Subscriptions, Fees & Payments

Subscription Terms: SafeTalk is offered on a subscription basis at $50/month, billed via Stripe.

Auto-Renewal: Subscriptions automatically renew unless canceled before the next billing cycle. Fees are generally non-refundable except where required by law.

Payment Processing: By paying through Stripe, you agree to Stripe's Terms of Service and Privacy Policy. SafeTalk may adjust pricing with prior notice.

10. AI Use & Safeguards

🤖 Artificial Intelligence Usage

SafeTalk uses AI technology for message processing in compliance with applicable regulations. All AI-generated content is clearly marked and requires your approval before sending. AI processing meets Apple and Google app store AI disclosure requirements.

AI Limitations: AI suggestions may contain errors, omissions, or bias. You must review all outputs before sending.

No Professional Advice: AI outputs are not legal, therapeutic, or medical advice.

User Control: SafeTalk delivers only the messages you explicitly approve. You remain responsible for the final content you send.

Third-Party Processing: AI processing may be performed by third-party providers subject to their policies.

11. Privacy, Security & Data Handling

Data Retention: Communications are retained for 90 days after account termination for standard users. Court-referred cases retain data for minimum 5 years or until case closure, whichever is longer.

Encryption: Communications are encrypted in transit (TLS 1.3) and at rest (AES-256), and decrypted only for user-approved processing, court orders, or valid legal reasons.

Court Records: For court-referred cases, complete communication records with tamper-proof digital signatures are available for legal proceedings upon valid court order.

Security Limitations: While SafeTalk uses reasonable safeguards, no system is 100% secure.

Breach Notification: If a breach occurs, SafeTalk will notify you within 72 hours through the app or other available means in accordance with applicable law.

App Store Data: Data shared with app stores is limited to what's necessary for app functionality, payments, and compliance.

We handle your data in accordance with our Privacy Policy.

12. License to User Content

To operate the Service, you grant SafeTalk a limited, non-exclusive, royalty-free license to use, process, transmit, and display your communications solely to deliver your approved messages, generate AI-assisted re-framings and suggestions, and comply with legal obligations.

SafeTalk will not sell or use your content for unrelated commercial purposes.

13. Third-Party Services & Providers

SafeTalk relies on third-party providers, including Apple App Store/Google Play for app distribution and payments, cloud hosting providers, and AI vendors for message processing.

By using the Service, you consent to third-party providers processing your data in accordance with their own policies. SafeTalk is not responsible for failures or actions of third-party providers.

14. Service Availability

Best Effort Service: SafeTalk strives for reliable service but does not guarantee uninterrupted availability.

Maintenance: Service may be interrupted for maintenance, updates, or technical failures.

Emergency Limitation: The Service is not a replacement for direct phone service or emergency calling.

15. No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, SAFETALK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: SAFETALK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. SAFETALK'S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID IN THE 30 DAYS BEFORE THE CLAIM.

SafeTalk is not liable for claims arising from your failure to obtain consent, violations of wiretap or privacy laws, or emergency communication failures.

17. Indemnification

You agree to indemnify and hold harmless SafeTalk, its officers, employees, and agents from claims, liabilities, or expenses arising from your misuse of the Service, your failure to obtain consent, or your violation of these Terms or law.

18. Governing Law & Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Arbitration: Any dispute will be resolved by binding arbitration administered by the American Arbitration Association (AAA) in San Mateo County, California.

Class Waiver: Disputes will be resolved only on an individual basis. You waive any right to a jury trial or to participate in a class action.

Small Claims: Either party may bring individual claims in small claims court in San Mateo County, California.

19. Termination

You may terminate your account at any time. SafeTalk may suspend or terminate your account if you violate these Terms, misuse the Service, or if required by law.

20. Modifications

SafeTalk may update these Terms. If changes are material, we will provide notice through the app, email, or other available means. Continued use after changes constitutes acceptance. Updates may be required for app store compliance.

21. General Provisions

Assignment: You may not assign these Terms without SafeTalk's consent. SafeTalk may assign in connection with merger, acquisition, or sale.

Severability: If any provision is invalid, the remainder will remain enforceable.

Entire Agreement: These Terms and the Privacy Policy form the entire agreement between you and SafeTalk.

Survival: Provisions on indemnification, limitation of liability, governing law, and arbitration survive termination.

22. Court Services & Legal Compliance

Family Court Services Referrals

Users referred by Family Court Services acknowledge that their use is subject to court oversight and California Family Code requirements. Court personnel may access communication records as legally authorized.

Legal Discovery & Court Orders

SafeTalk complies with valid legal process including subpoenas, court orders, and discovery requests. Complete communication records with metadata are available for court proceedings with proper legal authorization.

California Family Court Jurisdiction

Court-referred services are subject to California Family Code Section 3170, Rule 5.215 confidentiality provisions, and applicable California Code of Civil Procedure for e-discovery and record production.

Record Integrity & Chain of Custody

All court-related records include digital signatures, hash verification, and documented chain of custody to ensure admissibility in legal proceedings. Records are produced in court-specified formats within required timelines.

23. Equity & Accessibility

Fee Waiver Program

SafeTalk provides court-ordered fee waivers for qualifying low-income families. Fee waivers may be granted through Family Court Services referral or judicial order. Users must provide income verification and court documentation. Fee waiver status does not affect service quality or features.

Language Access Services

SafeTalk supports multilingual access with Spanish language interface and interpretation services. Court-referred users may request additional language support as required by California Language Access Plan. Translation services are provided for essential communications and court-related documents.

ADA Compliance & Accessibility Features

SafeTalk complies with Americans with Disabilities Act requirements and Web Content Accessibility Guidelines (WCAG 2.1). Accessibility features include screen reader compatibility, keyboard navigation, high contrast modes, and adjustable font sizes. Users may request additional accommodations through customer support.

Equal Access Policy

SafeTalk is committed to providing equal access regardless of income, language, disability, or technology barriers. No user will be denied service based on inability to pay court-ordered fees. Priority support is provided for accessibility needs and language services for court-referred cases.

24. App-Specific Terms

Device Requirements: SafeTalk requires a compatible iOS or Android device with internet connectivity.

App Updates: We may require app updates for security, functionality, or compliance reasons. Continued use requires accepting updated terms.

App Store Reviews: You may leave reviews on app stores in accordance with their guidelines. False or defamatory reviews may violate app store policies.

Offline Functionality: Some features may require internet connectivity. Cached data may be available offline but message delivery requires connection.
